Welcome to Our Caring Circle. These Terms of Service govern your use of our family caregiving coordination platform. By creating an account or using our services, you agree to these terms.
1. Acceptance of Terms
By accessing or using Our Caring Circle, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.
2. Description of Service
Our Caring Circle is a caregiving coordination platform that helps families organize and manage care for their loved ones. The service includes task management, appointment scheduling, member coordination, calendar integration, and related features designed to support collaborative caregiving.
3. Health Information Disclaimer (HIPAA)
Important: Our Caring Circle is NOT HIPAA compliant.
- This platform is designed for care coordination only, not for storing or managing medical records.
- You must NOT enter Protected Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA) into this platform.
- PHI includes, but is not limited to: medical diagnoses, treatment details, lab results, prescription information, health insurance information, and any data that could identify a patient in connection with their health status.
- We do not offer a Business Associate Agreement (BAA) and are not a covered entity or business associate under HIPAA.
- Use of this platform to store PHI is a violation of these Terms of Service and may expose you to regulatory risk.
Our Caring Circle is intended to help families coordinate who is helping with what, schedule appointments, and stay organized. It is not a substitute for medical record-keeping systems or healthcare provider portals.
4. User Accounts
When you create an account, you agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
5. Billing and Subscriptions
Our Caring Circle offers free and paid subscription tiers:
- Free tier: Basic features with limited capacity
- Paid tiers: Additional features and capacity, billed monthly or annually through Stripe
Paid subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through the account settings. Refunds are handled in accordance with our refund policy and applicable law.
6. Acceptable Use
You agree not to use Our Caring Circle to:
- Violate any applicable laws or regulations
- Store Protected Health Information (PHI) or sensitive medical records
- Harass, abuse, or harm other users
- Upload malicious content or attempt to compromise system security
- Use the service for purposes other than legitimate caregiving coordination
- Share access credentials with unauthorized individuals
- Interfere with or disrupt the service or servers connected to the service
7. Intellectual Property
The Our Caring Circle service, including its design, features, and content (excluding user-generated content), is owned by Our Caring Circle and protected by intellectual property laws. You retain ownership of content you create within the platform. By using our service, you grant us a limited license to use your content solely to provide and improve the service.
8. Disclaimer of Warranties
Our Caring Circle is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure. Our Caring Circle is not a medical service and does not provide medical advice.
9. Limitation of Liability
To the maximum extent permitted by law, Our Caring Circle and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service. Our total liability for any claims arising from or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these Terms of Service. You may delete your account at any time by contacting us. Upon termination, your right to use the service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the use of our service shall be resolved in the appropriate courts of the applicable jurisdiction.
